No BAAIs Mailchimp HIPAA compliant?
Checked 6 Nov 2026 from 4 vendor sources
We found no Mailchimp statement on offering or refusing a BAA, but its Data Processing Addendum bars customers from providing health information, and its terms put HIPAA suitability on the customer. Based on that, don’t use it with patient data.
What we couldn’t confirm
Mailchimp doesn’t explicitly refuse a BAA. Our result rests on its addendum, whose page carries a Preview label and says it took effect on 26 September 2024.
Proof from the vendor
- Mailchimp Data Processing AddendumBars customers from providing sensitive data, defined to include health information
- Mailchimp Standard Terms of UseSection 21 says the customer decides suitability under regulations like HIPAA and Mailchimp is not liable if the service falls short
- Mailchimp Acceptable Use PolicyBars importing sensitive personal information regulated by law; does not name PHI (updated Sept 26, 2025)
- HIPAA-Compliant Emails guideGeneral article that does not say whether Mailchimp signs a BAA
This isn’t legal advice. A BAA is one requirement. Your clinic still has to set the tool up correctly and control who has access. Vendors change their terms, so confirm with the vendor before you sign. PHI means protected health information, which includes patient data.
