Is WhatsApp HIPAA compliant?
Checked 6 Nov 2026 from 4 vendor sources
No Meta or WhatsApp statement about signing a BAA was found; WhatsApp’s business policy separately restricts health information where regulations require heightened safeguards. That isn’t proof either way. Treat it as unsafe for patient data until the vendor confirms in writing.
What we couldn’t confirm
WhatsApp’s health information rule depends on the local rules that apply and doesn’t name HIPAA. Read that clause yourself, and ask Meta if you need a firm answer.
Proof from the vendor
- WhatsApp Business Messaging PolicyBars telemedicine and health information use where regulations prohibit sending it to systems lacking heightened safeguards; applies to Business App and Business Platform (updated Sept 23, 2026)
- Meta Terms for WhatsApp Business PlatformNo mention of HIPAA, PHI or business associates found
- WhatsApp Business Solution TermsNo mention of HIPAA, PHI or business associates found
- WhatsApp Terms of ServiceNo mention of HIPAA; non-personal use barred unless authorized
This isn’t legal advice. A BAA is one requirement. Your clinic still has to set the tool up correctly and control who has access. Vendors change their terms, so confirm with the vendor before you sign. PHI means protected health information, which includes patient data.
