Best HIPAA compliant email marketing tools

5 tools compared. Checked 6 Nov 2026.

A patient list can count as protected health information on its own, because it shows who your patients are. Few marketing tools accept that.

Where to start

If you already use it, HubSpot covers this on Enterprise, and GoHighLevel offers a paid add-on. Paubox also lists Paubox Marketing under its BAA. Don’t load patient lists into Mailchimp or SendGrid.

GoHighLevel

On some plans

HighLevel offers a BAA through a HIPAA add-on listed at US$297 per month, available to agencies on any plan, or included in its Enterprise plan. Accounts are not set up for HIPAA by default.

Covered: Agency accounts on any plan with the paid HIPAA add-on, or Enterprise where HIPAA is included; BAA signed and HIPAA turned on per sub-account.

HubSpot

On some plans

HubSpot’s BAA is included by reference in its Sensitive Data Terms for covered entities and business associates, using the Sensitive Data feature on Enterprise subscriptions.

Covered: Enterprise subscriptions for Marketing, Sales, Service, Data, Content, Smart CRM and Revenue Hub.

Left out: Chatbots, personalization tokens, playbooks and sandboxes, and more.

C

Constant Contact

Not clear

Constant Contact will sign its standard BAA by email, yet it also tells customers not to put PHI in the service beyond the fact that subscribers have a relationship with the business.

Left out: PHI beyond the fact of a subscriber’s relationship with the business, and more.

M

Mailchimp

No BAA

We found no Mailchimp statement on offering or refusing a BAA, but its Data Processing Addendum bars customers from providing health information, and its terms put HIPAA suitability on the customer.

S

SendGrid

No BAA

Twilio states it cannot sign BAAs for SendGrid and tells customers not to use SendGrid for anything involving PHI.

Left out: SendGrid is not a HIPAA Eligible Service, and more.

Before you choose

  • Confirm the BAA covers your exact plan and every feature you’ll use.
  • Get the BAA signed before any patient data goes in.
  • Turn on the settings the vendor requires, and train your staff on them.

This isn’t legal advice. A BAA is one requirement. Your clinic still has to set the tool up correctly and control who has access. Vendors change their terms, so confirm before you sign. PHI means protected health information, which includes patient data.
